Customer Terms of Service

Interview Coder ("Company," "we," "us," "our") operates the Interview Coder desktop application and provides related products and services (collectively, the "Services"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your") and Interview Coder, governing your access to and use of the Services.
IMPORTANT: By downloading, installing, registering for an account, or accessing the Services, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use.
1. Service Overview and License Terms
1.1 Description of Services
Interview Coder provides an AI-powered desktop application that assists with coding interview preparation. The Services include both free and premium subscription offerings. Interview Coder observes your screen to generate contextually relevant assistance, but does not control your computer or make decisions on your behalf. Interview Coder does not record or process audio.
1.2 License Grant
Subject to your compliance with these Terms, Interview Coder grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Services for your personal coding interview preparation. The Services are licensed, not sold, to you.
2. The Services
2.1 Services
Interview Coder grants you a limited, non-transferable, non-exclusive right to access and use the Services during the Subscription Period for lawful internal business purposes.
2.2 Software
Interview Coder may make Software available as part of the Services. Software may update automatically. To the extent a component contains open source software, the open source license will govern that component.
2.3 Ownership
All rights and title in the Platform, Services, Software, and Documentation belong exclusively to Interview Coder and its licensors. No rights are granted except as expressly set forth in this Agreement.
3. Customer Data
You retain all rights to your Customer Data. You grant Interview Coder a nonexclusive, worldwide, royalty-free right to use Customer Data to maintain, provide, and improve the Services. For Enterprise Tier Services, Interview Coder will not use Customer Data to train AI models. For Free and Pro Tier Services, you grant permission to use Customer Data for AI training purposes.
4. Intellectual Property
All content generated using our service is owned by you, but the software, branding, and infrastructure remain our intellectual property. Any breach of our intellectual property rights will constitute a material breach and your right to use our Services will terminate immediately.
5. Fees and Payment Terms
You shall pay all applicable Fees within 30 days of invoice. All Fees are non-refundable except as expressly stated. If payment fails, we may suspend your access to the Services.
Auto-Renewal: Your subscription will automatically renew at our then-current pricing unless you cancel at least 30 days before renewal.
6. Warranties and Disclaimers
DISCLAIMER:
THE SERVICES ARE PROVIDED ON AN "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INTERVIEW CODER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
IN NO EVENT SHALL INTERVIEW CODER BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICES.
8. Term and Termination
Either party may terminate this Agreement if the other party materially breaches and does not cure within 30 days. Upon termination, your rights to use the Services terminate immediately. We may delete your data following termination.
9. Arbitration Agreement
IMPORTANT: All claims and disputes shall be settled by binding arbitration on an individual basis, not as a class action. You have 30 days to opt out by sending written notice to our address.
10. General Provisions
- Governing Law: Delaware law governs this Agreement
- Assignment: You may not assign this Agreement without our consent
- Entire Agreement: This Agreement supersedes all prior agreements
- Modifications: We may modify these Terms; continued use constitutes acceptance
